PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SERVICE. BY CREATING AN ACCOUNT OR USING KINTSUGI PROTOCOL, YOU AGREE TO THESE TERMS IN FULL.

1. The Service — What Kintsugi Protocol Is

Kintsugi Protocol is an AI-guided personal coaching program delivered by Kintsugi Protocol, LLC. The Service consists of a structured 7-session coaching protocol delivered over a 10-day commitment container, designed to help users identify and work through behavioral patterns. The Service is available at kintsugiprotocol.ai.

2. NOT Therapy — Scope of Service

IMPORTANT: Kintsugi Protocol is a COACHING tool, not therapy, psychiatry, psychology, or any form of licensed mental health treatment or medical service.

  • The AI "Coach" is a software program, not a licensed therapist, psychologist, psychiatrist, social worker, or any other licensed healthcare professional
  • Nothing in the Service constitutes medical advice, mental health treatment, diagnosis, or clinical assessment
  • The Service is not a substitute for professional mental health treatment or medical care
  • We do not diagnose, treat, cure, or prevent any mental health condition, disorder, or disease
  • We do not provide crisis intervention services

3. Crisis Support — Emergency Resources

IF YOU ARE IN CRISIS OR EXPERIENCING A MENTAL HEALTH EMERGENCY: Call or text 988 (Suicide and Crisis Lifeline) or call 911 (or your local emergency number). Do not rely on this Service for emergency support — it is not equipped or staffed for crisis response.

By using the Service, you acknowledge that Kintsugi Protocol is not a crisis resource and agree to contact appropriate emergency services if you are in danger.

4. Eligibility

  • You must be at least 18 years old to use the Service
  • You must have the legal capacity to enter into a binding agreement
  • The Service is currently intended for users residing in the United States. International users may access the Service but do so subject to their local laws

5. Account Registration

You agree to provide accurate, current, and complete information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at privacy@kintsugiprotocol.ai if you suspect unauthorized access.

6. Payment & Refund Policy

  • The Service requires a one-time payment of $197 USD (or the price displayed at checkout) to access the full 7-day protocol
  • Payment is processed securely by Stripe, Inc. By purchasing, you agree to Stripe's terms of service
Our Completion Guarantee

We stand behind this program. If you complete all 7 sessions and feel the experience was not worth your investment, we will refund you in full — no lengthy explanations required.

To qualify for a refund:

  • All 7 coaching sessions must be marked complete in your account (verified automatically by our system)
  • Your refund request must be submitted within 14 days of your Day 7 session completion date
  • Submit your request to support@kintsugiprotocol.ai with subject line: Refund Request

If you have not completed all 7 sessions, no refund will be issued. The program is designed as an integrated 7-day arc — partial completion does not constitute full use of the Service. We encourage you to complete your journey before making any judgment about its value.

Why we built it this way: We believe anyone who does the full work will find it worth every dollar. This policy is our way of putting our money where our values are — while being fair to both sides.

  • We reserve the right to modify pricing at any time. Price changes will not affect purchases already made

7. Acceptable Use

You agree NOT to:

  • Attempt to "jailbreak," reverse-engineer, or manipulate the AI coaching system instructions
  • Use the Service for any unlawful purpose
  • Share your account credentials with others
  • Scrape, copy, or redistribute Service content, coaching transcripts, or proprietary materials
  • Submit false, misleading, or harmful content
  • Use the Service if you are in a mental health crisis requiring immediate professional intervention

8. Intellectual Property

The Kintsugi Protocol methodology, coaching architecture, brand, interface design, blog content, and all associated intellectual property are the exclusive property of Kintsugi Protocol, LLC.

You are granted a limited, personal, non-exclusive, non-transferable license to access and use the Service for your own personal development. You may not copy, reproduce, distribute, or create derivative works from any Service content without our prior written consent.

Your Personal Protocol artifact (generated at the end of your 7-day program) belongs to you. You may share, print, or use it for your personal purposes.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KINTSUGI PROTOCOL, LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that any particular outcome or result will be achieved through use of the Service. Individual results vary.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KINTSUGI PROTOCOL, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising from your use of the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Kintsugi Protocol, LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms. Upon termination, your right to access the Service ceases immediately. You may delete your own account at any time through your dashboard Settings.

13. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of the State of California, without regard to conflict of law principles
  • Any dispute arising from these Terms or your use of the Service will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring individual claims in small claims court
  • YOU AND KINTSUGI PROTOCOL, LLC WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTION LAWSUITS
  • Any arbitration will be conducted in Contra Costa County, California, or remotely if you prefer

14. Changes to These Terms

We may update these Terms at any time. We will notify you of material changes by email or by posting a prominent notice on the Service at least 14 days before the changes take effect. Your continued use after the effective date constitutes acceptance of the updated Terms.

15. Privacy

Your use of the Service is governed by our Privacy Policy, available at kintsugiprotocol.ai/privacy, incorporated herein by reference.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kintsugi Protocol, LLC regarding the Service and supersede all prior agreements and understandings.
